Terms of Use

1. About these terms

These Terms of Use govern your use of the website at articon.com.au and the building and pest inspection services provided by ARTICON Pty Ltd (ABN 72 606 185 086, ACN 606 185 086, QBCC Licence 15014911) of 10 Valentine Circuit, Augustine Heights QLD 4300 ("Articon", "we", "us" or "our").

By using our website, requesting a quote, or booking an inspection, you accept these terms. If you do not agree with them, please do not use the website or our services. Nothing in these terms excludes, restricts or modifies any right you have under the Australian Consumer Law or any other law that cannot lawfully be excluded.

2. Use of the website

You may use our website to learn about our services, request quotes, book inspections, contact us, and (once available) access your customer account and inspection reports.

You agree not to misuse the website, including by attempting to gain unauthorised access to any part of it, interfering with its operation, submitting false or misleading information in our forms, or using automated tools to scrape its content.

We aim to keep the information on the website accurate and up to date, but it is general in nature and does not take your specific circumstances into account. Information on the website is not a substitute for an inspection of, or advice about, a specific property.

3. Quotes are estimates until confirmed

Prices shown on the website and quotes generated from your quote request are estimates based on the information you provide, including the property type, size and location.

A quote does not become a binding price until we confirm your booking, usually by email or phone. If the property turns out to be materially different from what was described (for example, significantly larger, or with additional structures to inspect), we may revise the price before starting the inspection, and you may cancel without charge if you do not accept the revised price.

4. Bookings and access to the property

When you book an inspection you must give us accurate details of the property and, where you are not the owner or occupier, confirm that you are authorised to arrange the inspection and to give us access.

You are responsible for ensuring that our inspector has safe and reasonable access to the property at the agreed time, including access arrangements with the owner, occupier or agent. Areas that are locked, obstructed, dangerous or otherwise inaccessible on the day cannot be inspected and will be noted in the report as not inspected.

If we attend the property at the agreed time and cannot obtain access, we may charge a reasonable call-out fee or require the inspection to be rebooked. Please give us as much notice as possible if you need to change or cancel a booking.

5. Reports are prepared for the named client only

Each inspection report is prepared solely for the client named in the report and for the property and purpose stated in it. Reports are not transferable, and no other person may rely on a report without our prior written consent.

If you are not the named client (for example, if you obtain a copy of a report from a seller or agent), you should arrange your own inspection. We accept no responsibility to anyone other than the named client, to the extent permitted by law.

6. Reports reflect the property on the inspection date

An inspection report describes the condition of the property as it appeared on the date and at the time of the inspection. Buildings and pest activity change over time: defects can develop, and termites or other pests can enter a property at any time after an inspection.

A report is not a guarantee of the future condition of the property and should not be relied on as one. If a significant amount of time has passed since the inspection, or conditions at the property have changed, we recommend arranging a new inspection.

7. Scope of inspections

Unless we agree otherwise in writing, our building inspections are non-invasive visual inspections of accessible areas carried out in accordance with Australian Standard AS 4349.1 (Inspection of buildings - Pre-purchase inspections - Residential buildings), and our pest inspections are non-invasive visual inspections of accessible areas for evidence of timber pest activity.

A non-invasive visual inspection has inherent limitations. It does not involve moving furniture or stored items, lifting floor coverings, cutting or drilling into walls, or dismantling any part of the structure, and it cannot detect concealed defects or concealed pest activity in areas that are not accessible or not visible.

If you book an invasive inspection, its additional scope will be agreed and documented separately before the inspection. The report will set out the scope of the inspection actually performed, together with any limitations and areas not inspected, and should be read in full.

8. Same-day report guarantee

We aim to deliver every inspection report on the same day as the inspection.

If we fail to send your pest inspection report to you on the same day as the inspection, the pest inspection fee for that job is waived. This guarantee applies to the delivery time of the pest inspection report and does not otherwise change the scope or content of the report or these terms.

9. Customer accounts

When customer accounts are available, you will be able to log in to view your inspection history and download your report PDFs. You are responsible for keeping your login details confidential and for all activity that occurs under your account.

Please tell us promptly if you believe your account has been accessed without authorisation. We may suspend or close an account that is used in breach of these terms. Our handling of account data is described in our Privacy Policy.

10. Intellectual property

All content on our website, including text, images, logos and branding, and all inspection reports we produce, are protected by copyright and remain the intellectual property of Articon or our licensors.

As the named client, you may use your inspection report for the purpose for which it was prepared, including sharing it with your solicitor, lender or other professional advisers assisting you with that purpose. You must not otherwise reproduce, publish, on-sell or distribute a report or the website content without our prior written consent.

11. Australian Consumer Law and liability

Our services come with guarantees that cannot be excluded under the Australian Consumer Law, including that services will be provided with due care and skill, be fit for any purpose you make known to us, and be supplied within a reasonable time. Nothing in these terms excludes, restricts or modifies those guarantees or any other right or remedy you have under law that cannot lawfully be excluded.

To the extent permitted by law, where the Australian Consumer Law allows us to limit our liability for a failure to comply with a consumer guarantee in relation to services, our liability is limited to supplying the services again or paying the cost of having the services supplied again.

To the extent permitted by law, we are not liable for loss arising from matters outside the agreed scope of the inspection, from areas that were inaccessible or concealed at the time of the inspection, from changes to the property after the inspection date, or from reliance on a report by anyone other than the named client.

Articon holds professional indemnity insurance and public liability insurance.

12. Privacy

We collect and handle personal information in accordance with the Privacy Act 1988 (Cth) and our Privacy Policy, which is available on our website and forms part of your dealings with us. By using the website or our services you acknowledge that our Privacy Policy applies.

13. Changes to these terms

We may update these Terms of Use from time to time, for example when we add website features or when the law changes. The current version will always be published on our website with its last updated date. Changes apply from the time they are published and do not affect bookings we have already confirmed, which remain subject to the terms in force when the booking was confirmed.

14. Governing law and contact

These terms are governed by the laws of Queensland, Australia, and you and we submit to the non-exclusive jurisdiction of the courts of Queensland. If any part of these terms is found to be invalid or unenforceable, the remainder continues in effect.
